H&M suing Forever 21 for copyright infringement

Forever 21 is being taken to court again, but this time by fast-fashion competitor H&M.

H&M filed a lawsuit against Forever 21 in July for copyright infringement, trade dress infringement, false dress designation of origin and unfair competition all for H&M’s ‘Beach Please’ tote bag. The Swedish fast fashion chain began selling the tote bag in April 2014 and has sold thousands worldwide. The company then filed to federally register its copyright in the design, which became effective in June of this year; the lawsuit followed shortly after.

The company demands that Forever 21 permanently cease manufacturing, marketing and selling its version of the ‘Beach Please’ tote and to pay its profits from the bags to H&M.
